In a CME session through your local dermatology society, a prominent drug company provides journal articles documenting the off-label use of one of their prescription pharmaceutical agents. Can you get jail time for a HIPAA violation?
Dr. Child was curious to know know some of the children who had been admitted to the hospital over the years and found a large amount of information. He was terminated when hospital officials became aware, and his actions were reported to authorities. He was found guilty of a HIPAA violation and given jail time. He didn’t share any of the information he found. How could he go to jail?
